The battle for justice for the more than half-million peaceful protesters of the August 2004 Republican National Convention continues with Mayor Bloomberg’s Law Department doing everything it can to delay the day of reckoning.

Five years after activists were illegally spied upon, swept up in mass arrests and held in toxic conditions in a dirty bus barn, the New York Civil Liberties Union and National Lawyers Guild are still fighting to get the full picture of the City’s conspiracy to disrupt lawful protest.

More than 50 lawsuits challenging the deprivation of civil liberties are still pending, although 87 protestors have accepted settlements. Of the 1,806 people arrested during the week of the RNC, 90 percent had their charges dropped.

How is the City managing to delay being possibly found liable for damages? Under federal rules of civil procedure, a federal magistrate, not a full lifetime-tenure judge, makes rulings on garden-variety discovery disputes. These decisions have the full force of law, and recourse to a federal judge is available under Rule 72 only if the magistrate’s decision is demonstrated to be “clearly erroneous or contrary to law.”

So rather than comply with magistrate orders to turn over secret NYPD documents and allow questioning of police officials about their policies in July and August 2004, the City continues to invoke Rule 72. Since the civil rights suits were filed in 2005, the city has invoked Rule 72 at least 10 times. Each time the rule is invoked, it causes delay, sometimes for as much as a year.

Interestingly, in March 2007, while these court battles were raging, someone leaked hundreds of documents marked “NYPD Secret” to the press. The documents detailed how undercover agents were sent to at least 15 places outside New York City 18 months before the RNC for the purpose of spying on activists and identifying “potential terrorists.”

The City blamed the civil rights lawyers for the leak. As a result, the deposition of David Cohen, NYPD deputy commissioner for intelligence, came to a halt. His transcript was sealed, and much of it is still under embargo. Ultimately, the city’s lawyers backed down and admitted they did not know who leaked the documents. The City is still resisting further disclosure.

Cohen, a former senior official in the CIA’s clandestine services department, was hired in 2002 by NYPD Commissioner Ray Kelly to build a CIA-style intelligence department within the NYPD, which is detailed in Christopher Dickey’s 2009 book, Securing the City.

Plaintiffs’ lawyers contend Cohen “formulated policy through the presentation of distorted intelligence data that culminated in the formulation and adoption of the nosummons and blanket fingerprinting policies,” and therefore he should be added as a defendant to the civil rights suits. On Jan. 23, 2008, magistrate Judge James C. Francis granted this request, finding that Cohen “holds a high rank in the NYPD and was therefore in a position to understand and influence policy-making for the RNC.” The Magistrate went further, writing, “The record indicates that Commissioner Cohen initiated the RNC surveillance program.”

This the Law Department could not abide. The City again invoked Rule 72, arguing that Francis’ order was highly prejudicial and “clearly erroneous.” Thirteen months later, on Feb. 21, 2009, Judge Richard Sullivan affirmed his Magistrate, saying Francis’ decision was “extremely thorough and well-reasoned.”

The City did not get the hint, moving to reargue rather than letting the case move toward trial. It got its day in court May 6 when a clearly annoyed Judge Sullivan told the City, “You’ve presented nothing new. These are arguments you’ve already made. You’re trying for a third swing at the bat … I find your tone frankly insulting.”

One can only speculate why the City is fighting so hard to keep Cohen from being added as a defendant and being forced to testify. As of September 2008, the city had spent $6.6 million just on lawyer’s fees.

Jeffrey Rothman, attorney for several of the plaintiffs, said that he believes the City is dragging its feet in part to avoid damage to the mayor during his re-election campaign or to his political heir-apparent, Ray Kelly.

“It is our hope this litigation will achieve accountability for the NYPD’s illegal, dishonest and oppressive practices during the RNC,” Rothman said, and “will help to prevent similar abuses by the NYPD in the future.”

When G.W. Bush stole the 2000 election our economy was stable and growing. The U.S. Government was engaged in the War on Drugs without sustained international military occupations. The World Trade Towers still existed.

Eight years later,

our financial banking system has collapsed. Major U.S. based global corporations are failing to bankruptcy. Unemployment rises. Home values decline. Inflation looms over us all.

We wage major military wars in Iraq and Afghanistan and have created civil unrest in Pakistan. Israel began 2009 with an invasion into Palestine.

Europe is purchasing U.S. corporations that have been the foundation of our economy for many decades.

Our privacy rights have disappeared.

Our health care costs are higher than the rest of the world.

Our food is losing quality and gaining cost.

Our environment is being devastated by our industry and lifestyle.

What was successfully protected and defended?

That said,

the U.S.A. is still ensnared in the seesaw battle of Republicans and Democrats.

At this point both sides are warmongers.

The primary difference right now is that when Republicans wage war it benefits the U.S. economy, when the Democrats do the same our economy weakens.

In my 35 years of life there have been 4 wars, one started by Dwight Eisenhower and the other three by George W and H.W. Bush.

All three of those men are Republicans.

Democrats are not capable of maintaining peace.

Something has to change.

We are writing you today to ask for your strong and committed support in action and solidarity in the search for justice for 8 activists unjustly and illegally imprisoned, tortured, badly treated, stigmatized by the media, and now awaiting possible incarceration for false accusations. Presently these activists, Jerónimo Gómez Saragos, Antonio Gómez Saragos, Miguel Demeza Jiménez, Sebastián Demeza Deara, Pedro Demeza Deara y Jerónimo Moreno Deara, members of the Other Campaign and residents of Ejido San Sebastián Bachajón, in the municipality of Chilón, detained on April 13th, 2009; as well as Alfredo Gómez Moreno y Miguel Vázquez Moreno, who is a a member of the Zapatistas, and was detained on the 17the and18th of April in the prison “El Amate” CERESS 14 in Cintalapa, Chiapas, Mexico. In the course of the next 4 days, ending on Friday, May 8th, the state will decide whether these activists are innocent and free from the crimes which they are falsely accused or whether they will be incorporated in the corruption of this government and imprisoned.

These activists, members of the Other Campaign and the Zapatistas, among the most active of those working for social change, are part of the first dignified voices to proclaim themselves against the new highway project that will connect the cities of Ocosingo and Palenque. These projects will initiate the basic infrastructure for a series of massive projects proposed by the government and multinational corporations. These projects engage in the theft of the abundant natural resources in the region and the implementation of a large scale tourism business that will destroy the surrounding environment.

If we allow this process to continue in silence, we, the national and international community will leave open the possibility for this government to continue their crimes; allowing repressions to continue against social activists; giving permission to torture, intimidate, and detain anyone that defends their legitimate right to live without fear and demand their basic human rights; we will allow them to continue to develop massive projects that will lead to the destruction of a dignified life for any human being.

Now is an important and urgent moment to act in every way possible to achieve liberty for these activists. In the next few days any type of political act in your city or country that will call attention to the unjust detention of these activists and support this struggle for basic human rights will help. We need to pressure the state government and administration of Juan Sabines Guerrero to liberate these political prisoners. Any act is useful whether it be in group or individual; marches, letters to the government of Chiapas and the federal government of Mexico, signed petitions, calls and letters to the press…will all bring attention to these injustices.

Encyclopedic evolution

Before Wikipedia,

comprehensive references on factual topics were most rapidly found in printed encyclopedias. This physically limited the amount of topics found in each series. Being printed as an indexed topic in an encyclopedia inevitably added cultural legitimacy to any topic.

The internet is enabling no limits to direct textual, audio and visual referencing of both archived and real-time, live forms of information.

The printed past is creating the initial trajectory of digital humanity.

Now anyone who learns of the worldwide web is capable of contributing or ingesting any aspect of this live electrical global collaboration~

which is not only evolving encyclopedias.

This net is evolving everything it touches.

Relationships, business, currency, gaming, communication...

for less than twenty years a new dimension has been actively participating in local and global life.

obstacles to Earthen salvation.

Politics and religion are heavily affecting our discussions of what is essential and necessary to transform society into a naturally sustainable process.

Certain aspects of modern culture in the U.S.A. and "first-world" societies cultivate problems that logically transcend the reactionary public conversations.

1~ Reliance on fossil fuels and electricity is depleting the land, air and oceans.

2~ Our buildings, streets and infrastructure such as water and sewage are typically being used to full capacity, with repairs moving slower than the rate of decay.

3~ A majority of people in the U.S.A. have never killed or grown the food that they eat every day.

4~ Bio and genetic engineering are replacing natural species of crops and livestock, making food that requires corporate chemicals to thrive.

5~ Democracy originating from the U.S.A. defined itself through Revolution that deliberately cast off a foreign nation's military and asserted moral and legal rights for all people everywhere, in writing.

6~ Peace and freedom are never created or maintained through war or intimidation.

All of the value in "supply and demand" logic that has always been the rational validity of Capitalism and Free Market Economies was transformed when the mathematics of the financial delivery system move from the realm of billions into trillions...
just because people lied about numbers being digitally traded between banks, governments and corporations.
Bookkeepers added three zeros to global financial markets. ( It is an interesting coincidence that this massive increase in mathematical economic modelling occurred shortly after computer scientists successfully developed the first "Petaflop" processing speed (1,000,000,000,000,000 calculations per second) .

Obama bummed me out.

Today the President of the United States of America devastated my hope and optimism for a better world.

He is intelligent and I know he cares about our nation and a better life for all generations to come. He is forced to deal with Bush policies that have ruled the land since 1980. He is attempting to revitalize a country that was ruled for eight years by the war criminal, G.W.Bush.

For those reasons and more, I have remained silent regarding his amplification of the war in Afghanistan. His failure to publicly investigate the possible (likely) violations of National and International laws by the Bush regime.

I remained silent while watching our government inject 800 billion dollars into financial institutions that have profited for years on legal lies and loopholes.


But now I cry out with rage and frustration.

The vilification of plants, herbs and fungus is an industry that condemns our Earth to destruction.

President Obama is capable of eloquent logic to justify letting Bush walk free, supporting corrupt corporations like AIG, and controlling the opium fields of Afghanistan with U.S. military...

but he uses sarcasm and scorn with regards to hemp.

This is a hopeless stance and I fear for us all.



The legalization of hemp and sin semilla (seedless) herb is not only the most requested topic on Government administered public polls. It is advocated by spiritual leaders and rulers of nations. Scientists and judges are in favor of legalization.

People sing and pray about it.

New developments in the reality of money.



Bush has apparently collapsed the entire value of our monetary system.




In an attempt to legitimize the U.S. economy our new president asks for 800 billion dollars that do not exist

and Congress agrees without even reading the legislation.

So, with the exception of President Obama (perhaps),

our leaders are agreeing to create money they do not have

by methods and strategy that they have not studied.

Or perhaps I am being misled by a Republican who appears to have regained critical thinking abilities after eight years of Bush adoration.

Go Weigh

In my travels I have observed that each place visited has at least one unique, traditional meal that tastes worse and costs more anywhere else on earth.

The Philadelphia cheesesteak (with fried onions)... fish tacos in San Diego (with salsa verde)... key lime pie in the Florida Keys.

These local staples are often marketed by food and restaurant corporations into global commodities.

If this drink becomes a global commodity I pray that it rewards the indigenous culture that it has nourished for thousands of years.

It is made by mixing dry, crushed corn into a hot cup of coffee.

It was shared with me near the Four-Corners area of the U.S, on land that was threatened by thirty years of mining.

It made a delicious and simple breakfast and tasted best with freshly ground corn.

1,000,000,000,000 reasons to indict G.H.W. and G.W. Bush ( and probably Jeb too )

The Bush family was attacked when it held the White House for a second time.

It has left again, this time adding three zeros to our debt.
We have military wars raging across Earth.
A majority of the population is physically and emotionally addicted to drugs.
Prison and Privatized War are growth industries.

Time will make it evident that we have been living with this trillion dollar debt for most of G.W. Bush's time in office. This was hidden from us by lies and misdirections...

Asking us to confront a trillion dollar debt simultaneously with a radical change in Presidents

damns us all to accept the final byproduct of the Bush Legacy :

turning the fruits of our labors into economic, environmental and emotional

degradation.


CHANGE we can enjoy life in

The goal of military, political and economic security should be increased freedom, liberty and expression.

National development of border conflicts and prison industries will only ever create increased escalation of misery.

Our public efforts need a shift in focus towards increasing fellowship and compassion.

The most compelling argument for success and security within the United States of America
is that it

stops defending what was and limiting what can be.

The majority of people on earth are still living very close to it. They are a part of it for their entire lives, 24 hours a day 7 days a week. The most crucial need for their success and survival is a healthy environment.

The industrialized people of earth are using electricity and technology to alter the natural progression of society and nature.

The internet has evolved into a new dimension interacting with our planet, enabling the industrialized people of earth to collaborate and interact without regard for physical boundaries.

Perhaps this "liberation from physical constraints" that We Industrialized People promote

is what justifies the corporate wars and police-state evolution.

Maybe success for everyone lies in the paradox of this global hive-mind moving from the mess and dangers of birth into responsible respect for the remnants of the Natural World.

This cannot be accomplished through stimulus packages or escalation of troop deployments.

We need to change our focus of change.

Bush Legacy




In less than two weeks the world will have at least four years of respite until Jeb returns his family aristocracy to the White House.

The differences that Barack Obama will inherently bring to the Presidency are more numerous than those of any other transition in my lifetime. Perhaps the only compliment I can possibly muster for G.W. Bush is that he is possibly the most physically fit person to ever hold the office. Even that will change on January 20th.

Obama is more literate than Bush. He is more intelligent. He is wittier. He speaks more clearly. He seems more genuine. He creates topics to discuss and react to, rather than the past eight years of being told everything was just fine the way it was.

The desire and dreams for peace and mindful growth demand an optimistic opinion of Obama's fortune and ability. Likewise for his family.

Including Bush I (G.H.W.) as Vice President in 1980, the Bush regime has held top power in the U.S. Government for 28 years (20 if you think they disappeared for Clinton)... their family aspires for control over We the People.

Barack Obama also aspires for that control, and it is his turn. His wife has not made a career out of politics, though she is quite capable of doing so and will inevitably hold influence as First Lady. Their daughters may aspire to politics someday as well, but this would be a result of being raised in that world... they would be second generation American aristocrats.

We are flipping from the most successful (for the Bush family) dynasty in the 232 years of our nation...

to the youngest.

Who’s influence weens us?
Me and my friends gratefully raged against the machine for three days
in the shadow of the valley of the dead
so big brother and company held us down while the wind cried
nothing to be gained here (except copied rights),
Then a questing tribe of beastly boys found a digable plant
where a buffalo soldier picked up a Gideon’s bible from the Godfather
in joe’s garage (or was it in one of 200 motels?)
Anyway, on a Holiday, the pinball wizard boy (Billie)
followed his heart and stopped pretending he was the king of the little plastic castles
while education, missed in the house of the naked apes, evolved and mutated
